  • Areas of Practice, Described

Civil Litigation: Generally, representing clients in the prosecution and defense of general civil litigation in state court. Civil litigation generally includes all disputes that are formally submitted to a court, about any subject in which one party is claimed to have committed a wrong, but not a crime. In practice and in ordinary conversation, lawyers and others concerned with civil litigation tend to treat many specialized subjects as outside this definition, such as labor law, as well as divorce actions and even small claims cases, even though all of these are technically types of "civil" litigation.

As a "general practice" firm we are frequently called upon to handle a wide variety of issues. These can include everything from simple to complex contracts to a motor vehicle accident.

Municipal Law: Rod Futerfas presently represents three municipalities, including Town of Woodstock, Town of Rochester and the Town of Denning. His responsibilities in this regard include advising the towns on a wide range of matters including zoning, planning, code enforcement issues and contractual issues.

Real Estate Law: In addition to the traditional residential house and business acquisition closings, Rod Futerfas represents a large number of institutional lenders who provide mortgage financing for house purchases. He also handles real estate litigation covering such areas as boundary line and quiet title proceedings.

Jerry Wapner also handles real estate matters out of our Woodstock office. Significantly more than half of Jerry Wapner's practice consists of work in various aspects of real property transactions including sales and purchases of residential properties, as well as raw land and commercial parcels. He has an extensive background, as well as hands-on experience, in most areas of real estate development and in conservation law and its practical implementation.

Jerry also devotes a substantial amount of his practice time to not-for-profit law and as counsel to a number of arts, religious and charitable organizations.

Rachel Cavell handles real estate matters out of our Kingston office and her Rhinebeck office.

Adoptions: Rod Futerfas handles domestic, foreign and interstate adoptions and has represented both natural and adoptive parents throughout the adoption process.

Matrimonial Law: Representing clients in negotiating separation agreements as well as pre-nuptial and post nuptial agreements, and also representing them in contested and uncontested divorce actions. Josh Koplovitz has been practicing in this area for over 40 years.

Family Law: Representing clients in the New York Family Court, including custody and visitation cases as well as in proceedings for child support and spousal support.
